London Tenant Secures £2,370 Compensation After Landlord Breaches Tenancy Deposit Rules

Mr. Z, a tenant in London, entered into an Assured Shorthold Tenancy (AST) in September 2009. Upon moving into the property, he paid his landlord a deposit of £2,370.

Mr. Z lived in the property for 13 years, during which he:

  • Entered into 8 different tenancy agreements
  • Stayed through 2 periods of periodic tenancies

Under the tenancy deposit rules outlined in Section 213–214 of the Housing Act 2004, landlords are required to protect tenants’ deposits within 30 days of receiving them.

After consulting with Mr. Z about pursuing a claim, our expert Tenancy Deposit Team at Phoenix Solicitors conducted a search to confirm whether his deposit had been protected in compliance with the rules. Unfortunately, we discovered that his deposit remained unprotected from 30th September 2022 to 9th November 2022.

Phoenix Solicitors took swift action against the landlord for this breach of the tenancy deposit rules. We successfully secured an agreement that Mr. Z should be compensated £2,370 (equivalent to 1x his deposit) for the violation.
