What is a Third Party Debt Order?

A Third Party Debt Order (TPDO) is a powerful legal tool that allows creditors to recover money owed directly from a debtor’s bank or building society account.

Once granted, the order instructs the bank to freeze the funds and—if successful—transfer them to the creditor, effectively bypassing the debtor. It’s often one of the fastest and most effective enforcement options when a County Court Judgment (CCJ) has gone unpaid.

When Can You Apply for a TPDO?

You can apply for a TPDO if:

  • You have a valid, unpaid County Court Judgment (CCJ)

  • You have reasonable belief the debtor has money in a bank or building society

  • The debt has not been fully repaid and no instalment agreement has been arranged

This method is available to both individuals and businesses.

How the Third Party Debt Order Process Works

Applying for a Third Party Debt Order involves several key stages:

Step 1: Eligibility & Preparation

Ensure a valid CCJ exists. Identify the debtor’s bank (e.g. from previous payments or credit checks).

Step 2: Application (Form N349)

Submit Form N349 to the court that issued the CCJ (or local to the debtor). A £131 court fee applies, which can be added to the debt.

Step 3: Interim Order

A judge may issue an interim order without a hearing, instructing the third party (usually the bank) to freeze the account up to the judgment amount.

Step 4: Notification

The court notifies both the debtor and the third party. At this point, the debtor cannot access the frozen funds.

Step 5: Final Hearing

Held typically within 28 days. The debtor may contest the order, and the judge decides whether to make the TPDO final.

Step 6: Final Order Granted

If granted, the bank releases the funds to you, settling the debt either in part or in full.

Freezing funds - The debtor cannot access the frozen funds

Act Quickly – Time Limits May Apply

While a CCJ is enforceable for up to six (6) years, earlier enforcement improves your chance of recovery. The longer you wait, the more likely funds may be moved or depleted.

FAQs

A TPDO freezes and recovers funds directly from a bank account. A Charging Order secures a debt against a debtor’s property. Both are enforcement options but used in different scenarios.

You’ll need to have evidence or a strong belief about where the debtor holds funds. If unsure, other enforcement routes like an Order to Obtain Information may be more suitable.

From application to hearing, it typically takes 3–5 weeks, but this can vary depending on the court’s schedule.

If the account is empty, the order won’t succeed. However, the process can still be a strategic move that pressures the debtor into paying or revealing other assets.

Yes, the £131 court fee can be added to the debt and recovered if the TPDO is successful.
