Our Client, approached Phoenix Legal Solicitors, to investigate a Clinical Negligence Claim against Southport & Ormskirk Hospital NHS Trust.
Our client sustained injuries to both his hands following a fall whilst playing football. He attended the A&E department at Southport Hospital, where he was seen by a nurse and a doctor. Our client had both of his hands X-rayed and was discharged, after being told he had no fractures. A few days later however, the X-rays were reviewed by another doctor, and it was identified that our client did in fact have intra-articular fractures at the bases of both metacarpals. Although this was identified, our client was not recalled by the hospital. The X-ray report was faxed to his GP surgery.
Since being discharged from the hospital, our client continued to experience severe pain in both hands and associated swelling, so he attended a walk-in centre. Here, he was advised that he did in fact have fractures. He was referred to physiotherapy at Arrowe Park Hospital.
Had our client been recalled to the hospital originally, after his fractures were identified, the appropriate treatment would have been started immediately. This would have significantly reduced his pain and suffering. However, it was the experts opinion that the treatment would have been the same.
Our evidence was presented to the defendants – Southport and Ormskirk Hospital NHS Foundation Trust, who admitted that they had breached their duty of care by discharging our client from A&E and failing to recall him when they identified his injuries. Several offers were made by the defendants, but these were rejected by our client after we advised that the offers were too low. Eventually, the claim settled, and our client secured damages equating to £4,000.00.
