What is a Third Party Debt Order?

A Third Party Debt Order (TPDO) is a powerful legal tool that allows creditors to recover money owed directly from a debtor’s bank or building society account.

Once granted, the order instructs the bank to freeze the funds and—if successful—transfer them to the creditor, effectively bypassing the debtor. It’s often one of the fastest and most effective enforcement options when a County Court Judgment (CCJ) has gone unpaid.

When Can You Apply for a TPDO?

You can apply for a TPDO if:

  • You have a valid, unpaid County Court Judgment (CCJ)

  • You have reasonable belief the debtor has money in a bank or building society

  • The debt has not been fully repaid and no instalment agreement has been arranged

How the TPDO Process Works

Applying for a Third Party Debt Order involves several key stages:

Step 1: Eligibility & Preparation
Ensure a valid CCJ exists. Identify the debtor’s bank (e.g. from previous payments or credit checks).

Step 2: Application (Form N349)
Submit Form N349 to the court that issued the CCJ (or local to the debtor). A £131 court fee applies, which can be added to the debt.

Step 3: Interim Order
A judge may issue an interim order without a hearing, instructing the third party (usually the bank) to freeze the account up to the judgment amount.

Step 4: Notification
The court notifies both the debtor and the third party. At this point, the debtor cannot access the frozen funds.

Step 5: Final Hearing
Held typically within 28 days. The debtor may contest the order, and the judge decides whether to make the TPDO final.

Step 6: Final Order Granted
If granted, the bank releases the funds to you, settling the debt either in part or in full.
