Mrs “D” took action against her landlord for a property in Heysham on the basis of the landlord failing to protect her deposit with any of the three (3) government-backed schemes within 30 days of receiving payment. This failure made her landlord liable for 2 breaches under the Housing Act 2004.

Failure to Comply with The Housing Act 2004

In accordance with S.214 of the Housing Act 2004, failure to comply with the laws surrounding tenancy deposit protection means a tenant will be paid up to 3 times the deposit amount, plus the deposit’s return.

Our client, Mrs D, paid a deposit of £650.00 at the beginning of April 2014.

Before seeking advice from Phoenix Legal Solicitors, Mrs D received an aggressive email from her landlord stating she would not be reimbursed her deposit and admitting that it was never placed in a protection scheme.

The Claim and the Settlement

Mrs D started her claim with us on 08/02/2024. Throughout March, the tenancy deposit team engaged in communications with the landlord. Negotiations took place covering a multitude of issues but by 26/03/2024, less than 2 months later, the landlord had accepted a global settlement offer of £2,440.00 plus Phoenix’s legal costs.

Mrs D was ecstatic with the result of her claim. The trust placed in us by Mrs D meant we were able to produce a justified, amicable and time-efficient solution to her dispute.
