What is Grant of Probate and Why Do You Need a Solicitor?

Grant of Probate is a legal document issued by the court which confirms the validity of the will and the appointment of the executor.

It also grants the executor the legal authority to manage and distribute the assets of the deceased person’s estate.

Our charges

Unless otherwise agreed in writing, our charges will be based upon two factors, namely time and value. Time includes time spent in travelling, supervisions, administration, Regulatory compliance and receiving letters.

The primary (but not exclusive) basis upon which we charge is by reference to the amount of time which is spent on the matter. Our current charging rates are given below and the level of the person dealing with the Probate will depend on the complexity of the matter, however, it will be no less than £220 + VAT at 20%.

We anticipate it could take between 2 and 20 hours of work at £220.00 per hour plus VAT at 20%. Total costs estimated at £440.00 – £4,400 (+VAT at 20%).

In addition to an hourly rate, we will also charge a fee based on a percentage of the Estate’s gross value. This is called the “Value Element” and is calculated at a rate of 1.5% and is subject to VAT of 20%.

The exact cost will depend on the individual circumstances of the matter. For example, if there is one beneficiary and no property, costs will likely be at the lower end of the range. If there are multiple beneficiaries, a property and multiple bank accounts, costs will likely be at the higher end.

We will handle the full process for you. This quote is for estates where:

  • There are no disputes between beneficiaries on division of assets. If disputes arise this is likely to lead to an increase in costs
  • There is no inheritance tax payable and the executors do not need to submit a full account to HMRC
  • There are no claims made against the estate

Additional charges

If there is no will or the estate consists of any share holdings (stocks and bonds) there is likely to be additional costs that could range significantly depending on the estate and how it is to be dealt with. We can give you a more accurate quote once we have more information.

Costs

Each Probate application differs depending on the value of the estate and the complexity of the estate. Therefore, we do not usually give a fixed fee for this work. However, once you have advised us of the value of the estate and the assets involved, you are ask for a fixed fee quote.

The costs are normally worked out based on our hourly rates which are:

Grade A Partners and Solicitors of more than 10 years qualification £350.00 + VAT (20%)
Grade B Solicitors of more than 4 years qualification £275.00 + VAT (20%)
Grade C Other Solicitors, Legal Executives and equivalent £220.00 + VAT (20%)
Grade D Trainee Solicitors and Paralegals £134.00 + VAT (20%)

Our charges hourly rates, and /or the agreed fixed fee will include:

  1. Collation of information from you as to the assets / liability of the estate.
  2. Contact with relevant parties such as banks.

Disbursements

These are fees that we pay to others on your behalf such as court fees, these are: 

  1. Court Fees estimated at £275.00 
  2. Copy of Grant of Probate – £1.50 
  3. Statutory notices estimate – £250.00 

Key Stages 

It is difficult to estimate the time scales due to significant delays at the Probate Registry or for tracing beneficiaries but we will keep you informed. The following timescales are guidance only: 

  1. Submitting, receiving and checking the grant (1 – 6 weeks) 
  2. Realising all assets and discharging all liabilities (12 – 24 weeks)
