What is a ‘Power of Attorney’ document?
A power of attorney is a legal document that lets you appoint one or more people to help you make decisions on your behalf if you become ill or have an accident and cannot make your own decisions.
There are two types of Lasting Power of Attorney (LPA):
- Health and Welfare
- Property and Financial
You can do one of the above or both. You can also cancel an LPA if it is no longer needed or you want to make a new one.
Do I need a Solicitor to help with get an Lasting Power of Attorney?
You do not need a solicitor to get a LPA but they can help with ensuring that the forms are completed correctly.
The cost to register the LPA with the Office of the Public Guardian is £82. You will also have the cost of the Solicitor on top of this.
- Health and Welfare LPA – This is in respect of your medical care, moving into a care home, life-sustaining treatment or even just your day to day routine. It can only be used when you cannot make your own decisions.
- Property and financial LPA – This is in respect of managing your money, bank accounts, paying bills, collecting benefits or a pension, or selling your home. This can be used as soon as it is registered.
Our charges for an LPA are £350 + VAT plus £82 court fee for Single Power of Attorney application (either Health and Welfare or Property and Financial LPA), or £500 + VAT plus court fees of £164.00 (£82.00 x 2) for Double Power of Attorney application (either Health and Welfare or Property and Financial LPA)
