Phoenix Legal have settled a claim in the sum of £10,000 for a child injured whilst at Nursery when she fell and suffered a 3cm laceration to her forehead above her left eyebrow.
Bella was allegedly running in nursery (which we would say is normal behaviour for a child at nursery) when she fell and collided with a concrete pillar that did not have any padding around it at child height, or at all.
Bella was taken from the nursery by ambulance to the local A&E department where her wounds were cleaned, dressed and steristrips applied. Bella was referred to the Plastic Surgeon team at Alderhey Hospital and was prescribed Kelocote which is a silicone ointment dressing. The hospital did not feel that suturing under anaesthetic would have given a better cosmetic result.
Our clients litigation friend reported that she had cut in a fringe to hide the scar and when Bella was cold the scar would turn purple.
On examination our Plastic Surgeon expert stated that the scar would be permanent and was 2cm in length. Our expert did not believe that scar revision would be required as it would not improve the scar and there was a risk of it making the scar appearance worse. He did believe that Bella may benefit from scar concealment through cosmetic camouflage.
An opinion from an expert in cosmetic camouflage was obtained to give details of the likely costs and needs involved over and above high street makeup and its coverage.
Once our reports were finalised and disclosed to the Defendant an offer was made, without an admission of liability, and a advice was sought from counsel.
The matter settled in the sum of £10,000.
The claim was then referred to the Court for an infant approval hearing. In cases involving minors the Court must approve the compensation, on behalf of the child. The hearing took place at Birkenhead County Court whereby the Court approved the award and payment of the compensation was ordered to be made into the Court funds office where it will remain until Bella is 18 years of age.
