Our Trainee Solicitor, Joseph Iveson, recently achieved a successful settlement in a Tenancy Deposit claim. Typically, these claims take between 3 to 6 months to resolve, but Joseph managed to conclude the matter in under 2 calendar months, from the date of instruction to the day our client received their damages.

What Was the Basis of the Claim?

The claim arose from the landlord’s failure to protect the tenant’s deposit, a requirement under the Housing Act 2004.

The deposit, paid to a London-based landlord, was not placed in one of the 3 secure Tenancy Deposit schemes, constituting a legal breach.

Under the Act, this failure can result in the landlord being liable for damages of up to 3 times the value of the deposit.
