£50,000 Scam Refund Secured for Client After Barclays Refusal
In October 2023, Mr A contacted Phoenix Solicitors after falling victim to a sophisticated investment scam earlier that year.
The scam left him without his life savings, caused severe mental health struggles, and led to the breakdown of his relationship.
How the Scam Unfolded
The scammer was introduced to Mr A by several family members who had also been deceived. She persuaded him to invest in what appeared to be a legitimate long-term scheme, claiming funds would be invested into shares of genuine companies.
To gain Mr A’s trust, the scammer used tactics such as:
- Citing legal advice from a genuine solicitor’s firm
- Providing a signed promissory note guaranteeing £85,000.00 if he invested £50,000.00
- Reassuring him that the investment was secure and risk-free
For months, Mr A believed his money was safe.
The Moment the Scam Was Exposed
After 12 months, Mr A requested to withdraw his funds. The scammer claimed there was a problem processing the withdrawal and then ceased all contact.
It was only then that Mr A realised he had been the victim of a scam.
Taking Action: Reporting the Scam to Barclays
Mr A first reported the scam directly to Barclays, who refused to issue a refund. The bank suggested this was a civil dispute rather than fraud.
When Phoenix Solicitors became involved, we:
- Prepared a formal complaint highlighting the hallmarks of an investment scam
- Presented evidence of Barclays’ failures in protecting Mr A from the fraud
- Argued that Mr A’s vulnerability and the sophistication of the scam were clear indicators the bank should have acted differently
Despite this, Barclays once again refused to refund Mr A.
Escalating to the Financial Ombudsman
We then escalated the case to the Financial Ombudsman Service (FOS).
The Ombudsman found in Mr A’s favour, overturning Barclays’ decision and awarding him:
- A full refund of £50,000.00
- 8% interest on the refunded amount
This outcome allowed Mr A to begin rebuilding his life with his savings restored.
