Background to the Case
Phoenix Legal team was instructed by the acting attorney of the victim, who had experienced sustained financial exploitation over several years. The victim, an elderly and vulnerable individual with limited mental capacity due to complex health issues, was befriended by a neighbour who went on to commit extensive financial abuse.
The perpetrator, known locally as a drug user, persuaded the victim to hand over her bank card, reveal her PIN, and sign multiple cheques in his favour. As the perpetrator’s confidence grew, the misuse of the account escalated significantly. The victim’s inheritance was drained and substantial overdraft charges accumulated.
The abuse was not limited to financial manipulation. The perpetrator frequently entered the victim’s home, removing and selling personal belongings, including jewellery and a television, for personal gain.
As a result, the victim was left without any funds, fell into rent arrears, faced the risk of eviction, and was unable to meet even her basic daily needs.
Legal Action and Recovery
Once the abuse was discovered by family members, Phoenix Solicitors was instructed to take immediate action. The firm advised that the matter be reported to the police, given that the perpetrator was identifiable and traceable. A police investigation commenced, and an arrest has since been made. The criminal investigation remains ongoing.
In parallel, Phoenix Solicitors carried out extensive recovery work to address the financial losses. Through persistent investigation and legal action, the firm succeeded in recovering over £94,000 in misappropriated funds.
The victim also received £800 in compensation for the severe stress and inconvenience caused.
