What is energy mis-selling?
Businesses of all sizes often use a broker that serves as a “middleman” when sourcing energy, the broker will then liaise with the energy supplier and provide a price for energy. Whilst the prices offered usually appear very competitive, it is not uncommon the energy supplier to pay a commission to the broker.
Although this should be transparent and explained to a business who is sourcing energy, commissions are often hidden and concealed into contracts or not visible because of inaccurate statements.
Andrew Pilley, the owner of Fleetwood Town Football Club, has recently been found guilty of a multi-million pound fraud involving mis-sold energy contracts. Through his sham telesales companies that were passed off as independent, businesses were contacted and persuaded to enter into energy contracts. Many of these contracts were passed to Commercial Power, also ran by Pilley. The Chairman was found guilty of fraud by false representation and fraudulent trading earlier this year.
How will I know if I am able to make a claim?
Following a 2020 investigation into energy brokers completed by Ofgem, business energy contracts were found to be mis-sold frequently. If your broker did not provide a full written disclosure of any monies that were paid to them as a result of your contract, it could be that they received a hidden commission from the energy supplier.

Some small business use more power than you might expect, such as tanning shops or operations with lots of machinery or tools.
What is the amount that I would be able to claim?
There are many variables to a claim, such as:
- how long the business energy contract was,
- how long you have been with that particular provider, and
- the actual price that you paid for the energy.
A good rule of thumb is you could recover up to 20% of any business contract that was mis-sold.
I am still under contract with my current energy supplier, could I still be eligible?
Yes, you can bring a claim against your current energy supplier. You may be able to renegotiate the terms and costs of the contract without the price of hidden commissions in there.
In some outcomes, an offer is made to cancel the contract which would leave the claimant free to move to an alternative supplier.

How long does a claim take?
