Energy Mis-selling - Have I been Mis-sold energy?

Businesses of all sizes often use a broker that serves as a “middleman” when sourcing energy, the broker will then liaise with the energy supplier and provide a price for energy. Whilst the prices offered usually appear very competitive, it is not uncommon the energy supplier to pay a commission to the broker.

Although this should be transparent and explained to a business who is sourcing energy, commissions are often hidden and concealed into contracts or not visible because of inaccurate statements.

How will I know if I am able to make a claim?

Following a 2020 investigation into energy brokers completed by Ofgem, business energy contracts were found to be mis-sold frequently. If your broker did not provide a full written disclosure of any monies that were paid to them as a result of your contract, it could be that they received a hidden commission from the energy supplier.

We offer a simple and straight forwards assessment process, this service is free and there is no obligation to continue with the claim.

Check if you can claim

I only have a small business, am I still able to claim?

Yes, you may still have an eligible claim. The more energy your business uses, the more you could be owed. Some small business use more power than you might expect, such as tanning shops or operations with lots of machinery or tools.

What is the amount that I would be able to claim?

There are many variables to a claim, such as:

  • how long the business energy contract was,
  • how long you have been with that particular provider, and
  • the actual price that you paid for the energy.

A good rule of thumb is you could recover up to 20% of any business contract that was mis-sold.

I am still under contract with my current energy supplier, could I still be eligible?

Yes, you can bring a claim against your current energy supplier.

You may be able to renegotiate the terms and costs of the contract without the price of hidden commissions in there. In some outcomes, an offer is made to cancel the contract which would leave the claimant free to move to an alternative supplier.

How do I make a business energy claim and is it difficult?

Our team would carry out relevant checks to find out if your business energy was mis-sold, before proceeding with any claim.

We would ask you to send us relevant documentation surrounding your energy contract, and with your permission, we would then contact both your broker, and energy supplier and go from there.

How long does a claim take?

Some claims are settled very quickly, as short as a couple of months. For others, it can take around a year, particularly with more complex agreements. We will of course keep you updated every step of the way, but once we have everything we need, we would carry out all of the work in the background.

What does it cost to bring a claim?

We will review your claim for free, and then if the claim is eligible, we would look to run it on no win no fee basis. This means that if your claim is not successful, you would not be charged.

If the claim is successful, our success fee is 25% of any compensation that is recovered.
